Testing Process


Prerequisites for Forensic Testing

Forensic tests can be administered only after the following prerequisites have been met:

·   Investigative and legal services providers have been identified and agree to participate in the case.

·   Completion of all legal planning, case investigation, and essential coordinations with appropriate authorities.

·   Tests can be successfully scheduled and developed.  Successful scheduling means in some cases that the appropriate criminal justice system or corrections organization must first approve the administration of tests that must be conducted based on contact with the pre-trial suspect or with the post-conviction prison inmate, i.e., Brain Fingerprinting Tests, DNA Tests, and others.


Developing and Administering Tests

Forensic service providers are responsible for planning, developing, and implementing tests.  Truth and Justice Foundation is responsible for contacting prison and jail officials and for scheduling tests that will be administered in prison.

In the case of Brain Fingerprinting Tests, obtaining test items is based on investigators' abilities to uncover new evidence, and using that evidence in the development of the tests.

In the case of DNA Tests, stored DNA samples must be made available to DNA testing laboratories for processing  from the Court or from appropriate law enforcement Evidence Control Units.

Provided that appropriate authorities or the client give permission to administer tests, the service provider conducts the test, and prepares it for delivery to the appropriate recipients. Truth and Justice Foundation monitors all processes undertaken by scientific laboratories, investigations experts, and other professional service providers.


Presenting Test Results to Authorities 

Following successful administration of forensic tests, service providers provide the results of the tests directly to the appropriate law enforcement, criminal justice authorities, court, and other clients. Legal authorities determine if, how, and when the test results are to be presented at a Hearing (if a Hearing is granted) or at a meeting with a corporate group.

Service providers also present a copy of the test results to Truth and Justice Foundation. T&J is responsible for evaluating all services and other activities, and reports the results of the evaluations to designated authorities, grantors, donors, and the media.  In accordance with the agreement between Truth and Justice Foundation and service providers, the terms and conditions of the agreement describe the processes and interactions between and amongst all concerned parties.
